ITC & PTAB
Two venues outside the regular courts decide patent fights that can reshape a company's business: the U.S. International Trade Commission and the USPTO's Patent Trial and Appeal Board. SecBot reports on both on the Court Judgements page, with a details grid that spells out where the case stands and who it helps.
The details grid shows where the case stands and who it helps.
USITC Section 337
Section 337 cases are import-ban cases. A company accuses a rival of unfair import practices — most often patent infringement — and asks the Commission to stop the products at the border. A win can lead to an exclusion order that keeps a competitor's goods out of the U.S. market.
ITC cards include an ITC Section 337 Details grid:
- Stage — complaint, institution, review of the ALJ's final initial determination, final determination, enforcement, Federal Circuit appeal or remand, terminated, or default remedy.
- Outcome — violation or no violation, marked as initial or final.
- Orders issued — limited or general exclusion order, cease-and-desist, bond — or the remedies requested if none have been issued yet.
- Presidential review end date — the end of the 60-day review period that follows a final determination.
- Products covered by the case.
PTAB trials
The Patent Trial and Appeal Board is where a challenger can ask the USPTO to cancel claims in an issued patent. PTAB cards include a PTAB Trial Details grid:
- Proceeding type — IPR (inter partes review) or PGR (post-grant review).
- Decision — trial instituted, institution denied, discretionary denial, or final written decision.
- Patent number.
- Claims cancelled and claims surviving.
- What the patent covers.
Reading the colors
Cells on both grids are colored good or bad for the matched company, based on its role in the case: complainant or respondent at the ITC, petitioner or patent owner at PTAB. The same outcome can be good for one side and bad for the other, so a red cell on one company's card may be green on its rival's.
Why traders watch these
- An exclusion order can block a rival's product line from U.S. sale, or block yours.
- A final written decision that cancels key claims can undercut a name whose story leans on that patent.
- Institution of a trial is an early sign that a patent is under real pressure, well before the final decision.
How much any of this matters depends on how dependent the company is on the products or patent in question.
Timing and matching
- ITC notices are checked every hour and appear about 3–5 days after the Commission acts.
- PTAB decisions are checked every 3 hours.
WARNING
Party matching for ITC and PTAB is strict: the party name must contain the company's core name, with known subsidiary-to-parent mappings applied. Expect fewer matches than for court rulings, but cleaner ones.
